TERMS AND CONDITIONS OF WARRANTY

INTRODUCTION

Your purchase of the Lesco Manufacturing Surge Pro Adapter constitutes your consent to be bound by the terms and conditions found in this warranty notice. This warranty notice contains important provisions which: limit Lesco Manufacturing’s risk and/or liability; place risk and/or liability on you, the consumer; result in your indemnification of Lesco Manufacturing; and otherwise constitute acknowledgements of certain facts.

It is very important to read this whole notice and you must pay special attention to the portions of this notice which are written in bold font.

1. APPLICABILITY OF WARRANTY

1.1. This warranty is for connected equipment (in other words, appliances which are you trying to “protect” from a high electrical surge, and which are connected (or plugged in) to the Lesco Manufacturing Surge Pro Adapter, and is subject to the limitations and exclusions listed below.

1.2. The warranty is in addition to, and will not impair, your, the consumer’s, statutory rights under current government, municipal, or local laws that are unalienable, nor your, the consumer’s, rights against the retailer resulting from the relevant sales / purchase agreement.

1.3. The warranty has a lifespan of 2 (two) years from the date of purchase of the Lesco Manufacturing Surge Pro Adapter.

1.4. Under the warranty, if all of the requirements are met, and you, the consumer, have not breached any of your obligations under this warranty, Lesco Manufacturing will repair and/or replace the connected equipment (with the decision to repair or replace the connected equipment being made at Lesco Manufacturing’s sole and absolute discretion) (and the Lesco Manufacturing Surge Pro Adapter), capped at R50,000.00 (fifty thousand rand) (“warranty cap”), on condition that the connected equipment is If equipment is damaged by a temporary voltage surge or spike (a “Occurrence”) while it is connected correctly and lawfully through a Surge Pro adapter to a properly wired power line with protective Earth, and the damage or destruction arose solely as a result of the Lesco Manufacturing Surge Pro Adapter being faulty / defective, but not as a result of misuse of the Lesco Manufacturing Surge Pro Adapter, faulty wiring or any other interference.

1.5. If the Lesco Manufacturing Surge Pro Adapter has been installed incorrectly, altered in any way, tampered with, or if the connected equipment has not been used under typical operating conditions or in compliance with any labels or instructions, this warranty will be void and of no further force or effect. It is not permitted to “daisy-chain” or connect Lesco Manufacturing surge protectors in series with other power strips, UPSs, surge protectors, or extension cables. ALL surge protectors must be plugged DIRECTLY into the power source.

1.6. Notwithstanding anything else contained in this warranty notice, the warranty only applies to consumers who: purchased the Lesco Manufacturing Surge Pro Adapter in the Republic of South Africa (“South Africa”); are resident in South Africa; have lawfully installed the Lesco Manufacturing Surge Pro Adapter in a premises in South Africa; and (a) can prove the date of purchase of the Surge Pro Adapter by presenting Lesco with an original invoice / slip (b) from a retailer who sells or has previously sold the Lesco Surge Pro Adapter.

2. REPAIR AND/OR REPLACEMENT

2.1. Lesco Manufacturing reserves the right to obtain its own quotations for repair and/or replacement, and shall, under no circumstances, be obliged to utilise a service provider or third party of your choosing.

2.2. Lesco Manufacturing may elect, at its sole and absolute discretion, not to repair or replace any or all of the connected Equipment. If Leso Manufacturing elects not to repair or replace any or all of the connected equipment, Lesco Manufacturing shall pay you an amount equal to the equipment’s fair market value or its original purchase price, whichever is lower, up to the warranty cap.

3. TYPES OF DAMAGES

The warranty only applies to direct damages. In other words, only the costs of repair and/or replacement of the connected equipment will be covered under this warranty, and NO DAMAGES whatsoever which may arise as a consequence of, or indirectly out of a defective product, which may or may not have been foreseeable at the time of the occurrence, will be covered under this warranty.

4. ACKNOWLEDGEMENTS

You agree, understand and acknowledge that the Lesco Manufacturing Surge Pro Adapter is NOT a lightning arrestor and will not protect against lightning strikes. The warranty will NOT be extended to damages arising from or in any way related to lightning strikes.

5. INSPECTIONS

Lesco Manufacturing reserves the right to inspect the damaged equipment, the damaged Lesco Manufacturing Surge Pro Adapter, and the source and location of the damage, whether in its own capacity or through the use of a third party. You agree that should you deny Lesco Manufacturing the opportunity to conduct the inspection, the warranty will immediately lapse and be of no further force or effect.

6. TIMEFRAMES

The warranty will not apply if you do not inform Lesco Manufacturing, in writing, at info@lescosk.co.za, within 3 (three) months of the date of the occurrence (and within 2 (two) years of the date of purchase of the Lesco Surge Pro Adapter.

7. YOUR COSTS

7.1. Any false / fraudulent claims shall result in Lesco Manufacturing invoicing you to recover any and all costs incurred by Lesco Manufacturing in investigating your claim, and you agree to pay such invoice immediately upon receipt of the invoice.

7.2. Any false and/or fraudulent claims shall be reported by Lesco Manufacturing to the relevant authorities.

7.3. You, the consumer, are responsible for covering the initial costs of shipping the Lesco Manufacturing Surge Pro Adapter and any damaged equipment to Lesco Manufacturing for inspection. Lesco Manufacturing will reimburse the shipping expenses only if and to the extent that the claim is accepted.
